RETAIL WHEELING NOT UP TO THE INDIVIDUAL STATES

Senator Bennett Johnston of California has warned that individual states do not have the power to order retail wheeling under the 1992 Energy Policy Act. Johnston, Chairman of the Committee on Energy and Natural Resources, said that Congress might have to intervene if the California Public Utility Commission (CPUC) proceeds with its controversial proposal to implement retail wheeling to allow third party access to the grid. The CPUC has said it will come up with a plan for it by the end of the year.
