AMSC-Sinovel dispute set to enter surpreme court

CHINA: A court hearing in the dispute between AMSC and Sinovel dispute is taking step forward tomorrow with a hearing in the Supreme People's Court in Beijing.

In this latest twist in the broad legal dispute, AMSC is seeking US$6 million compensation. It is asking asked the court to order Sinovel to stop using the allegedly stolen intellectual property (IP).

Sinovel has previously disputed two of AMSC’s copyright cases, arguing that that the venue is incorrect. The first court decision, in Beijing, did not favour Sinovel, although the Hainan court ruled for Sinovel and dismissed that case.

AMSC vice president of communications Jason Fredette told Windpower Monthly that AMSC  expects a favourable decision after the October 26 hearing. Such a ruling would overrule the Hainan ruling, hence Sinovel’s dispute of the venue.

Sinovel could not immediately be reached for comment.

In addition, Dejan Karabasevic, the former AMSC employee who was convicted and imprisoned in Austria for selling trade secrets relating to the AMSC’s turbine control systems, has been released from jail and is out on probation.
